SpeakMic Offline — Terms of Use

By installing or using the SpeakMic Offline Android application ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.
1. What the App does
SpeakMic Offline is a free Android application for push-to-talk walkie-talkie and one-to-many audio broadcast communication. All audio travels directly between nearby devices over WiFi Direct, Bluetooth (Google Nearby Connections), or a local WiFi network — entirely without internet access, a cellular connection, or any cloud infrastructure. No audio is recorded or transmitted to any server.
2. Free of charge; no warranty
The App is provided free of charge, as is, and without any warranty of any kind, express or implied — including, without limitation, warranties of merchantability, fitness for a particular purpose, or uninterrupted, error-free operation. Communication quality depends on factors outside our control (device hardware, radio interference, distance, network conditions). We make no guarantee that the App will work in any specific environment or for any specific purpose.
3. Limitation of liability
To the fullest extent permitted by applicable law, the operator of SpeakMic Offline (Mateusz Barniak, Poland, contact: [email protected]) is not liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with your use of, or inability to use, the App — including but not limited to damages resulting from communication failure, loss of data, or reliance on the App in any safety-critical situation. Do not use the App as the sole means of communication in emergencies or safety-critical situations.
4. Acceptable use
You must be at least 13 years old to use the App. If you are below the age at which you can consent to the processing of your data on your own in your country (16 in Poland), use the App with the permission of a parent or guardian.
You agree not to use the App to:
- broadcast or transmit content that is unlawful, defamatory, harassing, or hateful;
- record or re-transmit other participants' audio without their knowledge or consent, where such consent is required by applicable law;
- interfere with other users' devices or attempt to disrupt the App's operation.
You are solely responsible for the content you transmit and for complying with all laws applicable to your use.
5. Updates and availability
We may update or discontinue the App at any time without notice. These Terms may also be updated; continued use of the App after an update constitutes acceptance of the revised Terms.
6. Governing law
These Terms are governed by the laws of Poland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.
