Terms of Service

These Terms of Service ("Terms") govern your use of SpeakMic ("the Service"), operated by Mateusz Barniak, Poland, contact: mateusz@barniak.net. By creating or joining a room, you agree to these Terms.
1. Description of the Service
SpeakMic is a lightweight tool for live audio communication, peer-to-peer (WebRTC), with an optional text chat. In a Broadcast room, one "broadcaster" streams live audio to a number of "listeners" who join via a link or QR code. In a Walkie-Talkie room, any participant can press a talk button to speak to everyone else, one at a time. The Service is provided for live communication only: audio is not recorded, stored, or made available for later playback.
2. Eligibility and acceptable use
You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use the Service. By using the Service, you confirm that you meet this requirement.
You agree that you will not use the Service to:
- broadcast or share content that is unlawful, defamatory, harassing, hateful, or infringes the rights (including intellectual property or privacy rights) of others;
- distribute malware, spam, or attempt to disrupt, overload, or gain unauthorised access to the Service or its infrastructure;
- impersonate any person or entity, or use the Service to facilitate illegal surveillance or recording of others without their consent;
- use the Service in a way that violates any applicable law or regulation.
You are solely responsible for the content you broadcast or send via chat, and for ensuring you have any consents required from your listeners (for example, if local law requires notice that a session is being broadcast).
3. Rooms, tokens, and PINs
Anyone with a room's link or QR code can join it (as a listener, or as a participant in a Walkie-Talkie room, optionally requiring a room PIN you have set). Anyone with the broadcaster or admin access token for a room (stored locally on the device that created it) can act as that room's broadcaster or admin, including sending chat messages, managing PINs, removing participants from a Walkie-Talkie room (and blocking them from rejoining), and deleting the room. If you set an optional admin PIN, keep it confidential — anyone who knows it can reclaim broadcaster/admin access to that room. You are responsible for keeping room links, tokens, and PINs secure and for all activity that occurs through your room.
4. Room lifetime and deletion
Rooms are temporary by default and are automatically deleted after a period of inactivity (1 day by default). When creating a Broadcast room, its creator may instead make it "permanent" (this requires setting an admin PIN). Walkie-Talkie rooms created by users are always temporary; permanent Walkie-Talkie rooms can only be set up by the Service's administrators, for example as part of curated landing pages. A permanent room persists until it is deleted manually or until it has had no activity for 3 months, after which it is automatically and permanently deleted. We do not guarantee that any room or its contents (including chat history) will be retained for any period of time, and we may delete rooms at our discretion, for example to address abuse or technical issues.
5. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that audio/connection quality will be sufficient for any particular purpose. Because audio is transmitted peer-to-peer, quality and connectivity depend on each participant's own device, network, and browser.
6. Limitation of liability
To the maximum extent permitted by applicable law, Mateusz Barniak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.
7. Third-party services
The Service relies on third-party infrastructure to function, including edge/hosting infrastructure (Cloudflare) and public STUN servers (Google) used to establish peer-to-peer connections, as described in our Privacy Policy. Your use of the Service is also subject to the availability of these third-party services.
8. Changes to the Service or these Terms
We may modify, suspend, or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
9. Governing law
These Terms are governed by the laws of Poland, without regard to its conflict of law provisions, unless mandatory consumer protection laws of your country of residence provide otherwise.
